When you can show you care about the worker, you'll be cutting your chance of a lawsuit. The employee, in effect, fired himself. Second, as we discussed in Chapters 2 and 3, a fired worker will often sue you even when sacked for legitimate reasons. Not all employees respond to verbal warnings. Often Human resource Managers refer to this as progressive discipline. Or, if the small business is big enough, you can transfer him and give your insubordinate employee to another supervisor. What does a bad outlook look and sound like? Therefore, it is important for you to either get a bad worker in shape or to lay off her or him before it leads to more problems. This is because the former employee can use the employee termination letter if he or she files a grievance or a legal action claiming. When firing troublesome workers, personnel workforce or small business owners should try to curb personal feelings. You're on the road to change — you have identified the bad behavior, counseled and disciplined the jobholder, but the worker just can't seem to increase.
These workforce know when they come to work that management may layoff them "at any time for any reason." However, a wise employer will not look this solely from his or her own perspective. Often laid off workers will file lawsuits because they feel the firm treated them unfairly during the layoff method. This gives the ex-worker a chance to vent his frustrations, which lessens his anger and his desire to sue you. You should expect an impasse which at times happens with negotiated dismissals.
